The litigation finance contract is based on the award, not whether GDSI can collect the award.

Why did GDSI up the A/S to 2B during the litigation?

The company thinks they're getting Rontan, IF they can get the courts in Brazil to agree. That would be the "proceeds". Wouldn't be surprised if GDSI isn't already shopping this "settlement".
