The judgement is quite clear, his Honor going so far to list and itemize exactly the amounts are due and to whom.
To state otherwise is highly misleading.
Highly misleading. Using that incorrect thought process, one then states the judge awarded GDSI an amount equal to exactly the outstanding tax liabilities.... why on earth would any judge use an amount equal to exactly the outstanding tax liabilities as “damages” ???
The “damages” award is that Bilky and GDSI don’t get stuck ultimately paying it. Those taxes however, will be paid by GDSI, BUT coming from the settlement funds due the Bolzans, again paid by GDSI for the benefit of the Bolzans, FROM sale proceeds that otherwise would have gone directly to the Bolzans. Remember my simplified example of a business purchase ? Instead of paying the seller his $100, the buyer paid $40 of taxes previously owed by the seller and then proceeded to pay the seller the $60 balance due.
Pretty simple for ALMOST ANYONE to understand
However, we both know that Bilky isn’t going to pay the Bolzans not a single dime.
That will be the subject of the next litigation...
