BUT, the way the "Hybrid' CTs were structured, they (the CTs) are Guaranteed to the Trust, by placement of Lehman Common Shares, at the Trust. That is the way they were structured so that LBHI could use the 'Hybrid' structure of CTs to raise the 'Debt' from the Markets and claim the 'interest' paid on them, as 'an Expense' on the Balance Sheet and at the same time Count them (the CTs) as "Tier-1' Capital'.
