First, MTVX and this "PhytoLife Organics" were never licensed and bonded. I don't know where the heck you're getting this info but it's flat out wrong and conjecture.
Second, it's trivially easy to work the SEC's enforcement into a petty fine or something less with a good lawyer. Seriously, if you're dabble in RM plays, you better have a good working relationship with an attorney who can dot your Is cross your Ts and tell you what to say to the SEC so they go away.
In the case of MTVX and Troy Covey: It's only illegal if you get caught.
