One of the reasons was the perjury element. When the ARYC parties had their collars felt, they did not make things worse by denying all wrongdoing and then impugning the honesty and motivations of the investigating authorities. In DECN's case, that approach seems to have resulted in both a delay in, and a subsequent doubling down of the enforcement action. But it looks like Berman has now well and truly fallen off that Tiger he was riding, and seems well on his way to being roundly filleted by it, methinks!
