My previous post was what the 4th amendment would include as a minimum. I expect them to go further though.

An interesting idea I saw floating around said that the seniors might be written down to near-nothing rather than nothing at all, and that the dollar-for-dollar liquidation preference increase as FnF retain earnings might be kept, at least until Treasury truly deems the seniors paid back (as if they weren't already).



I think they want to preserve plaintiffs standing for the lawsuits to continue so that final adjudication can happen. If so, then they have to structure it in a way that preserves standing but also gives Calabria the power to end the conservatorship if judicial remedy fails. The treasury stake and agreement is what will prevent Calabria from ending conservatorship so they got to get that resolved if they can without mooting the cases. It would be a lot easier if they did amend it to resolve everything and let the courts decided on mootness and I think that is also an option.
