So whats your point? Under a provisional patent application the IP is protected for a period of 12 months. So if HALB files for a provisional patent application they have 12 months to decide to file for a non-provisional application. And in the mean time nobody can "steal" it. And whether it works, we know if HALB/ASU concludes their R&D.

Therefore, an applicant who files a provisional application must file a corresponding nonprovisional application for patent (nonprovisional application) during the 12-month pendency period of the provisional application in order to benefit from the earlier filing of the provisional application."
