Did you notice the time/day stamps? The case was already dismissed before Percy and/or opposing council decided that a record of stipulation be entered Did you notice it was Sector 10 who asked to make an offer? Is that what plaintiffs ask a court if they won a settlement?
"Offer made by Sector 10"
They did resolve the case with NO monetary settlement What would Percy be offering in a dismissed case?
The offer would have amounted to "mercy" in my opinion.
Ole Percy got spanked by the judge and the plaintiffs sunk the dagger.
The fact is Judge Pettit ordered mediation for a settlement and if no settlement a trial was ordered. Both parties no doubt engaged in mediation and it is likely offers were made back and forth prior to all the happenings in sept and oct.
There were additional arguments before the court for more discovery on 9/29/20 and the Judge put in an order denying motion to reconsider.
Remember the case had enough merit for the judge to have ordered mediation to get it settled out of court months ago.... NOTHING CHANGED!
On 10/5/20 it is put into the records that both parties are attempting to resolve case and that an offer was made by Sector 10.
On 10/29/20 the Bench trial was cancelled and the reason given was: CASE HAS SETTLED

The Court considered all of the Defendants' briefing. as well as Sector 10's responses thereto, and granted all of the Defendants' motions for summary judgment on the trade secret issues and related claims, and its ruling was not solely with respect to Dutro's motion for summary judgment. The Court declines to exercise discretion to reconsider its prior rulings on the summary judgment motions because (1) the matter is not being presented in a new or different light, (2) there has not been a change in the governing law, (3) there has not been the discovery of new evidence, and (4) the Court does not have a conviction that the prior decision was clearly erroneous based upon the record and arguments made before it on the motions for summary judgment in October 2018, and Sector 10 either did or could have raised the arguments at that time. Therefore, for the reasons set forth on the record, which are incorporated herein by reference, the Court denies the motion to reconsider.
