I'm not sure that Dr Schena won't get any time here. Even with a deal, it seems like the penalties are pretty harsh. NOTE: I'm not saying this is the way it's going to go. He might get probation. I'm just saying that if there is a SEC conviction, here's a few averages to review.

A few highlights from the doc that could be relevant here:

The majority of securities and investment fraud offenders had little or no prior criminal history (83.9% of these offenders were assigned to Criminal History Category I)

Sentences for securities and investment fraud offenders were also increased for: Violation of securities or commodities law by an officer or director of a publicly traded company, broker, dealer, or investment adviser (28.0%).?Leadership or supervisory role in the offense (19.7%).

The average sentence length for securities and investment fraud offenders was 57 months
