The emoluments provision in the United States Constitution makes it illegal for any administration to use their office to enhance the wealth of themselves or any family members. If Elizabeth Warren gains traction with this complaint against Kushner, his sister and the Trump White House, this could blow sky high. My research shows that the Warren complaint has been stonewalled in the McConnell Senate. This could suddenly change if the balance, there, swings, after the election.
This is one to watch, IMO. FHFA as conservator could be adjudged as complicit to criminal activity that violates the Constitution. Looks like the Kushner stuff happened after Mel Watt, but before Mark Calabria was sworn in. I was actually wondering if this "problem" had something to do with Otting's sudden exit @FHFA and several leadership changes @FMCC and FNMA where senior executive leaders hit the exits abruptly.
I have wondred if Calabria, sensing personal risk here on an inherited problem, has used concern over this to lead defense attorneys to abandon defending the legality of the Agency's structure.
The part about FHFA having indulged Kushner's gains could be influential in the SCOTUS orals in Collins v. Mnuchin. Could this be the straw that breaks the camel's back on the question of whether to blue pencil the "for cause" crap in HERA... or... throw the entire FHFA baby out with the (tainted) bath-water and tell Congress to start over?
Time will tell.
