That's why a bulldozer may be the appropriate remedy here for SCOTUS, it would accomplish 3 important functions:

(1) Send a message to the US Congress that "experimenting" with novel forms of the 4th Branch of government could result in the whole "experiment" becoming dismantled, as this court takes seriously the Separation of Powers Doctrine as a major protector of individual Liberty rights.

(2) It will remedy past abusive and coercive actions by the FHFA.

(3) It will allow the gses to finally become rehabilitated (wasn't that the whole purpose of HERA?)

What problems would the shareholders face with such an outcome:

(1) Would FSOC deem the gses "systemically important" and set whatever capital requirement they deem appropriate?

(2) If one party controls POTUS and Congress, would they draft new legislation that puts the gses in a worse position?

Inquiring minds want to know....
