I don't think the election is of great concern. They could have negotiated something shortly after Calabria became FHFA Director but they didn't do anything at that time either. If trump is reelected I don't expect them to do anything until scotus rules. The reason they haven't done anything is because any serious amendment would have mooted the lawsuits. They want the lawsuits to render the judgment instead of admin action. There also appears to be pushback from some within the admin.
