On purpose perhaps? Mistake, at best.

A nonprovisional utility patent application must include a specification, including a description and a claim or claims; drawings, when necessary; an oath or declaration; and the prescribed filing, search, and examination fees.

If a Company asserts, as this one has, that it has "filed a patent application with the U.S. Patent and Trademark Office in support of Brilacidin’s use as an anti-viral treatment including the SARS-CoV-2 virus", and it doesn't include all of those elements, it has made a false statement.

Think of it like a Nasdaq listing application. If your application doesn't include ALL the required elements, you haven't actually filed the application.


Here's the answer to your basic shit question:
If a company says it filed an app and it’s not complete or it doesn’t have all filing material requirements it HASN'T FILED AN APP.
If that's what you propose has happened (I don't think it is) you might want to take the CEO to task for making a false statement.
