My bad. I should have used lower case, “decision”. The Document is titled, MEMORANDUM & ORDER and at the end of the Order is a summation titled, “Conclusion”. I classified the Document as a, “Decision”, as an overall term for the conclusions drawn and so ordered. There was no intent to imply that the Document was a Final Decision. Having said that; If I had seen this sooner than yesterday, I would have removed myself as Mod, and said goodbye months ago.
I read the Doc. multiple times, and can come up with only one impression, and it ain’t good. The Defendant(s) should not have filed their Motion. They are in a worse position now than before. What I see is a Judge who is looking to have every “I” dotted and every “T” crossed, so the Defendants(s) have no appealable issues due to Plaintiff’s failure to comply.
I believe the Defendants are toast.
It’s been interesting. I am no longer a Mod andI will not be responding to any comments, good or bad. I suggest carefully reading the entire Document. I don’t see that there are any questions left to ask.
