I see it as substantially different than the Apple/Samsung case. When somebody bought a Samsung tablet due to this feature, it was a lost tablet sale for Apple. Apple was "damaged" due to the Samsung violation of their patent which allowed Samsung to take away Apple sales. Again, my question is what sales did HDVY lose, and on what products?
