I am not sure what you mean by "NOT a first time patent infringement case."

I suspect Intel's response will be two fold:
(1) The patent is invalid. Algorithm patents are a very gray area and this could go either way. The judge in the interference proceedings chose not to rule on this claim.

(2) Intel does not infringe the patent. In skimming through the very long complaint, it appears to me most is about how Intel's customers and partners infringe the patent. It is unlikely Intel will be held accountable for what their customers and partners choose to do with their products.

Given the complexity of this case, I suspect it will take quite a while for it to resolve.
