A 4th possibility which bears mentioning is that Mitch thought anybody really important who was on the fence about CBD Legalization would be easier to persuade if he could point to the FDA’s CBD Enforcement Discretion policy

Legalizing CBD before the FDA planned on issuing its CBD Enforcement Discretion policy is a bigger legislative leap

It can feel to some Congresspeople as if they are overruling the FDA

But if the FDA already developed an Enforcement Discretion Policy, then voting for CBD Legalization is a smaller step

Remember, in 2019 the FDA stated it didn’t feel comfortable issuing Enforcement Discretion until safety was assured

So the FDA’s issuance of a CBD Enforcement Discretion policy is its rubber stamp of approval in terms of safety

In the eyes of certain people in Congress, CBD Legalization is no longer some rebellious act of “playing doctor”

The FDA is giving the green light now

It’s OK to legalize CBD
