Going back to CAFC? The other additional a year and half for CAFC makes decision. Must be kidding!! Why going back to CAFC??? Last time you said PTAB must returned back to CAFC, but that not happened . Now you say going back to CAFC again.
Perhaps there will be more motions, discovery matters, and other requests, bla, bla, bla, but this case is NOT going back to CAFC.
All issues such as patent obviousness/abstract & patentability matters, settlement discussion/encouragement, procedures, motions and others court matters will be dealt with at district level. At this stage of the pre-trial or trial, this case is NOT going back to CAFC.
