Remember: It was the government who appealed the Collins En Banc, so a denial, means the En Banc decision, favoring shareholders, stands. Source:

Since it was the government who appealed to the US Supreme Court, this means that the government loses!!

Just going by the odds it says this case will be denied - "only 20-25% of the petitions distributed for a given conference are actually discussed during that conference and few, if any, of those discussed, are granted. Those which aren’t discussed, become automatically denied." Now, taking in to account the amount of money in play and it does seem more likely they hear the case.
