That is not how it works. The EMA case is completely independent of their disclosure requirements and in no way affects what they can say or not. They certainly don’t need to talk about the case itself, but there is no requirement or need for it to affect appropriate disclosures about their business.
In fact they have an obligation to report material events via 8K...and no lawsuit can stop or negate that requirement.
