The bigger issue is the COLA. If they have submitted anything to the TTB, you don’t want any suggestion of IP infringement.

TTB approves and USPTO refuses.

Bureaus can be most difficult to deal with.

That said, this makes about have a dozen attempts by Bob to get the mark, correct?

Plus Tony claimed APRU was part owner of the Hard Rush mark, which is false. There is no trademark.
