"when it's off to the auditors it's out of the company's hands". True enough, but in such a situation it is extraordinariIy stupid for Gary to give anybody a timeframe for when the 10K wiII be fiIed.

I disagree. With the 10K being as late as it already is, and with the Stop Sign being in place, I think that Gary has to provide some kind of timeframe.
Shareholders are not happy with how late the 10K is, and they are requesting updates in this matter.
It would be "extraordinarily stupid" to remain completely silent and give no update whatsoever.
At least now there is a reasonable expectation that we should see the 10K this week (ie: by tomorrow), or perhaps early next week. That is better than if Gary had provided NO timeframe whatsoever.
