en banc aka Collins case gave opinion and sent it back to Judge Atlas for remand.

We are still waiting on Atlas to rule on the remand. Supposed to be out by fall.

Speculation is that Atlas is waiting on Scotus to give cover before ruling against gov't.

Speculation being the key word here.
