It may or may not be ATVI.It could be Bungie
that settles before ATVI to give a sense that they are not attached at the hip.But as time moves forward it will cost ATVI more or trial and possible treble damages

ATVI clearly won't settle before the 101 and Estoppel issues are resolved. Very unlikely but always a small chance they could win. After that, there are no more issues to resolve and the serious negotiations begin. They likely will make low ball offers which increase as the trial date approaches. If the Discovery process is fruitful the price may go up or the possibility of an earlier settlement.
