Not all Judges follow procedures or the law as we know from the VRNG debacle. Judges are human and have bias, or political leanings and some are activists. However, most Judges try to follow the law and decide cases on legal precedent. Most Judges give a defendant their say and indulge in what results in a delay, which generally eliminates that issue as an appealable issue. When a Judge rules on a case they don't want the case coming back for appealable issues or being overturned by a higher Court. Many cases are appealed as a matter of course, not because there are legitimate appealable issues.Judges try to make the record clear.
