Yes most likely. Or aim to muddy the waters and seek some kind of “go away” consideration.
Ultimately they just went away as all they have is someone’s biased recollection of a conversation vs the clear, organized, definitive explanation of the outcome ultimately set forth and approved.
Either Mica lied to the GFive guy or the GFive guy is lying or misheard. One of those 2 things. Know how I know? Because ALL of the bids were revealed. None of them involved a share purchase.
GFive had ample opportunity to file an objection to the court ordering the sale to the JV and litigate a resolution to the "he said he said" dispute, which would have likely been an order for a "best and final" from each bidder. But they didn't. Guess the thought of tossing in another million or so wasn't worth it to them.
