One of the criteria that the SEC uses to determine if they are going to pursue an investigation is the monetary damage to the investing public.

Somebody losing $500 or $1K due to a company's fraudulent promotions is not going to do it. Multiple investors losing many hundreds of thousands of dollars would probably at least get their interest.

And if anybody decides to file a complaint, the more info you supply the better - copies of PRs, copies of promotional emails, logs of conversations, and so on, all that will help in the investigation.

The term "low-hanging fruit" is what I have heard used......if they can spend little effort to make their case, they'll be more likely to proceed.
