There have been plenty of legally actionable statements made by and about NNVC. The following has been allowed to stand in a very public venue for quite a while and it contains a couple of doozies...highlights mine:

How many employees does NNVC really have? Isn't it closer to half a dozen?
None of the listed drugs has been commercialized. I'll bet you remember when they used that term on the home page of the website and took it down when that fact was pointed out.
The Company could defend those falsehoods as appearing in public statements that they don't control, but there is zero doubt that they are deceptive and that the origin of the language is in filings that the Company itself made with the SEC multiple times. The most recent filings are clear when they say "To date, the Company does not have any commercialized products" and there is little doubt that the false statements that still appear in the public could be corrected with a phone call...guess the company is either too busy to bother or is happy with the public access to those false statements.

The problem with "legally actionable" is that someone actually has to be willing to take the action and in spite of the fact that there have been numerous opportunities to do so (prior to last week) and the share price has been crumbling for years, no one was moved to act.
It will be interesting to see if a stumble from today's heights will provide the necessary motivation.
