Sorry to butt in here, but this is an interesting point. Is the argument that, unless you have knowledge of the general guarantee when you purchase it would not otherwise apply? On the surface, that appears to be a BS statement.
If the general guarantee is part of the prospectus, and you agree to purchase a stock, then you by default are agreeing to any provisions outlined therein, I would think. Similarly, when you purchase a good or service (software, for instance) you are bound by the provisions in the small, small print that comes up for you to hit the "Agree" or "Disagree" button. If you choose to disagree, I don't think it will work for you.
