They could , but they wouldn’t be using the word properly so I doubt they would as words carry far more weight in the courts. How about this? Please find me any appellate court rulings that “affirm” a death penalty rather than “uphold it” or “confirm it” and then we can look at that case and see if said death penalty was a positive or negative outcome for society
