Well, I just use it to purchase shares. I can purchase other stocks with my margin. But, fcel is restricted for both brokers.

Yes, that is policy but there is nothing in the law or regulations that punishes brokers for violating that policy. I know for a fact that Interactive Brokers will loan shares in a non margin account and I suspect other brokers would do the same if they can make money.
