By that theory, supreme Court should not pick this up on Jan 10th. Agree? So that the govt has an excuse to wrap up this one putting their hands up in air??

I respectfully disagree. Not a lawyer but my understanding is it only takes 4 SC judges to grant certiorari and hear the case. There are 4 pro-government, liberal SC judges that might disagree with the 5th circuit...We will find out Jan 10th

I would be ok with it going to the SC. We would have a final answer by June and I believe FnF shareholders would win 5-4
