I would bet that FDA would stall big time. Just look at the years and years of Big Pharma pushing opiods and what exactly have been the penalities for that. FDA had no problem with opiod abuse. These people are sick minded and in charge. It's up to the individual states for regulation consistent with legalization of THC.
