Suspect Lamberth don't like getting lied to in his court. And Lamberth has ruled against Gov in the past, just not in this case............yet.

Fairholme (Lamberth) has both direct and derivative claims. Most likely direct will get shot down during a trial and derivative will continue = another nail in the coffins for JPS.

I would assume both are direct and BOTH are derivative - as defined and determined by a court - judge
