Nothing to avoid, every trader that sells and buys back before waiting 30 days under same wash rule, it's a big nothing burger... especially playing penny stocks...

Can you call the broker and get them to assign first in first out? To possibly avoid it?

It was a FIFO order. They explained it to me but I just can't wrap my head around it.
