It’s a complex mix right now, but I think Mitch’s move to legalize CBD in Foods and Dietary Supplements via making CBD exempt from the drug exclusion clause in the FDCA remains the betting favorite

We know it was before the FDA’s remarks last week, per Jonathan Miller, Mitch’s right-hand man on Hemp Legislation

And unless Mitch or somebody close to him says otherwise**, I don’t see why the FDA’s remarks would necessarily change that outcome

So as you’ve already pointed out, as things stand right now, the setup is still there

Under Mitch’s legislation, the FDA would still maintain regulatory authority, only once adding CBD to foods, beverages and dietary supplements becomes federally legal, the FDA will be forced to quickly develop interim regulations around Pure CBD products with enforcement discretion — otherwise, they would be blamed entirely should any future safety crisis arise in the CBD industry because it remained unregulated AFTER Congress specifically legalized CBD-containing products

The people at the FDA have a ton of professional pride and they are already smarting from the vaping crisis — Congress has been reaming them out for the past few months for that

Vapes, E-cigs and CBD products are all industries which the FDA has allowed to flourish unregulated over the past 6-7 years

They got badly burned on the vaping crisis and they don’t want to allow another very rapidly growing legal industry with potential safety hazards to go unregulated

They don’t want to get burned again — that would be a black mark for the FDA

It’s Mitch’s move now

He has an impressive history of getting things done, especially in the hemp industry

So let’s see what happens from here
