Normally correct but in such a situation with strings still attached to the stock market in the form of shareholders' shares in broker accounts, working on relisting, problems already happened with the SEC and can't risk any more, anticipating shareholders who may sell privately based on information, I'd say it's safer to act as if still a public company.
