Here’s another logical interpretation of what just took place with Mitch’s legislation that makes sense of its odd timing — before the FDA has even had a chance to publish their report/regs/recs in October

The FDA can now feel “comfortable” issuing enforcement discretion right now in October, if they didn’t feel comfortable doing so without Congressional legislation

Watch this clip from March where Dr. Gottlieb mentioned that Congress will need to pass legislation in order for the FDA to issue a regulatory framework — numerical cutoffs for purity, concentration and potency of CBD — with enforcement discretion for CBD products that meet these criteria

So the FDA may have actually requested Mitch to pass his legislation in September, in order for them to issue their regulatory framework and enforcement discretion alongside their comprehensive report that’s due out this month:

“Congress would obviously give direction to the agency (FDA) to do that (publish a regulatory framework to which enforcement discretion can be applied)...”




That’s what Dr. Gottlieb said back in March

With the recent vaping crisis, the FDA has been taking A LOT of heat from Congress about how they should have regulated vapes to prevent this type of crisis

There is so much political pressure on the FDA to put out CBD Regs ASAP

Once the USDA Regs are published, the pressure on the FDA is only going to increase

The Republicans want to maximize the 2020 Hemp & CBD economy for the farmers and rural voters ahead of the 2020 elections, and waiting until January to issue Regs, 3 months after the USDA Regs have been published, would actually harm the 2020 planting season

It takes several months of planning for these farmers to line everything up, and without the certainty that would come from the FDA Regs, the market to purchase raw hemp is a lot smaller

So political analysis + Dr. Gottlieb’s own words from March and again in August, suggest FDA Regs are coming sooner than later
