Thank you for explaining your position. I think I understand it. I also understand that Tmmi called the license VDK 2 in its claim when it sued Dimension. It wasn’t the court that gave it this label. It was also Tmmi who said that they were no longer using VDK 2 or anything related to it when they dropped their lawsuit., So Tmmi bears some responsibility here for the confusion.
The court will also wonder why Tmmi bothered to purchase DFM, a company which Tmmi believed owned “VDK 2”, when Tmmi already owned the more valuable VDK 2.1, etc.
Ultimately it’s not me that you have to convince. It’s the court. You may find that they won’t understand quickly and I think that will frustrate you. I imagine the licenses will have to be produced, and there will have to be experts called in to analyze the codes. HP may have to be added again. A long drawn out process and an expensive one.
