The GSEs announced that they intend to sweep last quarter earnings to treasury, right? I think so. If so then if treasury decides not to take it they would look like they are in agreement with the en banc decision. If they sweep and then announce that we will build capital after this last sweep then they look like they are choosing not to sweep instead of appearing like they are complying with the en banc decision. It is childish but also leaving the door open for more sweeping in the future as they are showing that treasury is making the decisions here, not the judicial. "You're not the boss of me!
