There are several different types of gaps.
Not all are "filled" contrary to popular belief.
Investopedia explains ONE type of gap, which does not "fill":

The Difference Between Different Types of Gaps
There are some fundamental differences between the different types of gaps. For example, reversal or breakaway gaps are typically accompanied by a sharp rise in trading volume, while common and runaway gaps are not. Additionally, most gaps occur due to news, or an event such as earnings or an analyst's upgrade/downgrade. Common gaps happen more regularly and do not always need a reason to occur. Also, common gaps tend to get filled, whereas the other two gaps may signal a reversal or continuation of a trend.

The gap you speak of is a "breakaway" gap, based on news (En Banc ruling), accompanied by large volume. It probably wont fill that gap.

The breakthrough gap should not be closed. Otherwise, it means weak. So I do not think that $2.4 gap would be filled.

$2.45 gap fill still going to stick with that.

reasons:

1 - impending market correction

2 - lengthy ruling of CSHIP release and actual legal proceedings to follow

3 - bash pieces to bring price down for large investors to load up

4 - because charts never lie

Long on FNMA - long and realistic.
