Haha, it's at the SECs discretion. Being on the SECs bad side these days is bad for business. If they have you under their microscope, any slip up will get you halted. The SEC has cracked down on 60 or so penny stocks since July. Enough people have been burnt here where its caught the SECs attention.

So to answer your question, I don't know but it is a risk.
