Oh, without a doubt, it is always intentional. Perhaps, the concerns were better expressed here and here by Small Time Tina, since they reflect some of the same concerns.
What is obvious and few seem to understand is the $CMGO CEO claimed, several times, from January 16 when the court case was voluntarily dismissed (ending whatever the hell an "Attorney, Client Rules during a RICO Litigation and Lawsuit" might be), ending all litigation, through April 1, that the settlement could not be discussed until $CMGO was current. Then, $CMGO released the settlement numbers on April 9, causing a massive sell-off before the market even opened. However, despite this sharing of the settlement numbers, $CMGO was still not current. That did not happen until August. So, the entire $CMGO BOD lied about the NDA or violated it. It's that simple.
Perhaps this will clear it up:
January 16, 2019- $CMGO v. Hudson Gray, et al is voluntarily dismissed, ending all litigation.
Shortly after, several claim to have received emails from the $CMGO CEO saying he is limited by "a very strict NDA."
April 1, 2019 - the CEO posts: "I want to be clear, my hands are tied. Until CMGO is a reporting company, either SEC or OTC alternative the NDA prohibits the disclosure of any settlement terms. It appears it may be a couple of more days before that happens. Believe me I'd like it to be now."
April 9, 2019 - A $CMGO Press Release is issued detailing the settlement terms. (Click for link) $CMGO is still not a "reporting company," yet the settlement terms are released.
August 13, 2019 - $CMGO provides more news (Just click here to see) stating, "Management has posted CMG Holdings’ last two years of financial statements on a recently-designed CMG website at https://www.cmgholdingsinc.com and filed them with OTCMarkets.com, bringing the Company current with its financial reporting requirements and removing YIELD and STOP signs that have been hindrances to investors in the Company’s stock over the past few years." At this point, $CMGO is fully-reporting, not earlier when settlement terms were released.
