bob, yes, but the CD vulture can't naked short, cause SYTE is fignting the past actions of the cd holder and is requesting to pay in cash, but the cd holder is refusing cash payment for obvious reasons since he has shorted the heck out of syte and if forced to take cash by the courts, there is no recourse for the CD holders but to buy back the shares they have shorted. The hearing is this October if I am not mistaken.
