They're not even remotely close in the CA case to any final decisions being made, not by a 1,000 miles.
Also, a case in CA has no bearing on a 3 judge appellate panel. Again, the only thing the appellate court reviews and considers is "Did judge Ungaro make any error in law, or how she conducted her court" etc. Nothing else is considered on a Federal appeal, nothing. Certainly not some other case in another state, LOL !
The 3-judge panel can care less what happens in CA. They're only reading the written brief presented before them, written by USRMs attorney the usual Mitrani, and he must convince that panel that Ungaro made some gross error "of law" or "misconduct in her court", period.
Again, this is not a re-try at the legal case and it merits or arguments or anything else- it's only a review of how the lower court conducted itself and came to its decision "per the law", it's the only thing under consideration on an appeal. Period.
Again, lets stick to actual facts here. California has zero to do with anything related to this federal appellate appeal, absolutely nothing. Anyone familiar with the appellate process knows that, it's basic law 101.
