Trump's "fix" to Housing as a campaign issue will be based on reducing regulatory barriers for home construction and added inventory to drive prices down for single and multi-family homes for purchase and rent. The first shot was already fired in this direction with the HUD PR recently released.

A SCOTUS appeal if the en banc goes "too far" in GOV cost will never get discussed by the Administration, and that aspect to reform will be another can kicked down the road for Congress to consider... which may never happen.

If the en banc is not favorable to the government and it wants to appeal, guess who will file the appeal? It's Treasury and the worthless goofball Mnuchin. How demeaning would that be?
