The Federal Reserve is not an official agency of the United States Government and could not escrow funds for the U.S. Government on its books. There is NO escrow account for reimbursement back to Fannie Mae and Freddie Mac. The structure of the Fed as set forth in the Federal Reserve Act was deliberately structured to avoid political influence by maintaining separation between working "with" the government and working "for" the government.

The quarterly swept GSE money has been spent. If Collins en banc or some other court rules on an award for plaintiffs, GOV will have to appropriate the money via Congressional budget action and signed by the President.
