Plaintiffs will not give anything on the verge of victory.

Only the Collins plaintiffs are on the verge of victory. If the NWS is really unwound and the seniors cancelled, what would the plaintiffs in any other case hope to gain by holding out? Remember that the government can drag any case out nigh indefinitely, just see Sweeney's cases.

We need to clarify then: are you talking about only the Collins case, all of them, or some subset?
