Also, how do you know there will be no settlement?

I am of the opposite opinion. I think Collins is the only case that even has a chance of a final ruling, and that might not even happen. All the other cases will be settled because that's the only way to get recap and release done. Waiting for final rulings, appeals on those rulings, etc. will take several years. The various plainitiffs have very little to gain if the administration offers to end the NWS and cancel the seniors.
