No one can or should judge unless they're walking in Dr. Schena's shoes.

If he doesn't hurry up, the SEC is likely to be the one who "judges".

Do you understand that filing periodic financial reports is a REQUIREMENT, not an OPTION? And it isn't that big a deal, or shouldn't be. The fact that is is for ARYC suggests there's a problem.
